1. Purpose

The Wizard of Oss (“Company,” “we,” “us,” “our”) respects the intellectual property rights of others and expects its users to do the same. This DMCA Compliance Policy outlines the procedures we follow in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) and related regulations.

2. Designated Copyright Agent

Pursuant to the DMCA, the Company designates the following agent to receive notifications of alleged copyright infringement:

3. Filing a DMCA Takedown Notice

If you believe that material available on thewizardofoss.com infringes your copyright, you must submit a written takedown notice to our Designated Agent containing the following elements (per 17 U.S.C. § 512(c)(3)):

1. Identification of the copyrighted work you claim has been infringed.

2. Identification of the material claimed to be infringing, including the specific URL(s) on our website where the material is located.

3. Your contact information, including full name, mailing address, telephone number, and email address.

4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

6. Your physical or electronic signature.

Notices failing to provide all required information may not be processed.

4. Counter-Notification Procedure

If you believe material you posted was removed or disabled in error, you may file a counter-notice with our Designated Agent containing:

1. Identification of the material that has been removed and the location (URL) at which the material appeared before removal.

2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

3. Your full name, mailing address, telephone number, and email address.

4. A statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, for any judicial district in which the Company may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we may restore the material unless the original complainant files a court action seeking to restrain such restoration within 10–14 business days.

5. Safe Harbor Conditions

The Company complies with the DMCA’s “safe harbor” provisions by:

• Responding promptly to proper notices of infringement.

• Removing or disabling access to infringing material upon notification.

• Accommodating standard technical measures used by copyright owners.

• Not receiving a financial benefit directly attributable to infringing activity where the Company has control.

6. Repeat Infringer Policy

In accordance with the DMCA and our Terms of Service:

• Accounts of users determined to be repeat infringers will be suspended or terminated.

• A “repeat infringer” is defined as any user for whom we have received two or more valid DMCA notices within a twelve (12) month period.

7. Record Retention

We will maintain records of DMCA notices, counter-notices, and our actions in response for a minimum of three (3) years.

8. Indemnification

By submitting a notice or counter-notice, you agree to indemnify and hold harmless The Wizard of Oss, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising from any misrepresentation or breach of the statements contained therein.

9. Severability

If any provision of this Policy is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

10. Governing Law

This Policy shall be governed by and construed under the laws of the United States, without regard to conflict of law principles, provided that users located in the Netherlands may also rely on applicable Dutch law in parallel.

11. Revisions

We may update this DMCA Compliance Policy from time to time. Updates will be reflected in the “Last Revised” date above and become effective immediately upon posting.
